In South Korea's copyright law, there are three concepts: original works, copies, and derivative works. The requirements for the establishment of derivative works, which are distinct from copies, are mainly twofold.
The first is creativity. The criteria for judging this vary slightly depending on the subject and genre, and can be summarized and defined as 'creative individuality containing thoughts and emotions.' The second is that the creator of the original work must grant permission for the creation of the derivative work.
Subsequently, depending on the intent and purpose of the original's use, it can be classified as homage, parody, etc. If permission is not obtained, it may be considered unauthorized use or copyright infringement, leading to penalties and liability for damages. However, if the copyright has expired, the permission stage from the creator may be omitted.
The debate over whether photography can be considered art began with the advent of photography. In France, it was stated that photography is merely a mechanical process without a soul and cannot be compared to the works of artists, which are the result of dedication and contemplation.
Photography was recognized as the eighth art after a century of debate starting from the mid-1800s (according to the French classification). Today, it can be broadly divided into 'documentary, archival photography' and 'art photography.'
The exhibition visualizes two works as original works, copies (3D prints), and functional works (3D drawings). It highlights the subtle relationships formed between objects that exist in three different forms but are essentially the same.
Ctrl+C and Ctrl+V, copying and pasting, can instantly create as many copies as desired from the original, triggering related debates depending on the subject and medium. Photography has established itself as a field of art, with numerous discussions and agreements along the way.
Like AI, virtual currency, and the metaverse, more intense debates and more complex agreements are expected (or are already underway) in the process of reaching consensus on many originals and copies in the future.
